Full Service Agreements-

Our service contracts provide you with 24 hour emergency service at no extra cost. When ever
trouble pops up, service is just a phone call away. Two system cleaning and performance checks are included to help prevent breakdowns and maintain your system’s efficiency performance.

SERVICE AGREEMENT

WE AGREE TO:

1. Inspect the equipment on a scheduled basis as shown and during each inspection perform the applicable services and furnish a copy of the list to you upon completion.
2. Furnish parts and labor necessary for equipment as listed on front when a failure or breakdown of any component part causes the equipment under agreement to become inoperative; subject to exclusions as listed below.
3. Instruct you in the operation of the equipment.
4. Give our service agreement and warranty holders preference over all other service activity normally undertaken by us.
5. Price will remain the same on annual renewals.

YOU AGREE TO:

1. Operate and maintain the equipment according to our instructions, check and clean the filter monthly.
2. Promptly notify us of any unusual operating conditions of the equipment.
3. Permit our personnel the use of your common building maintenance tools, such as ladders, etc.
4. Permit only our service personnel and/or a service organization authorized by us to work on the equipment.
5. Make equipment accessible for proper service.
6. If our efforts to contact you with in 6 months have been unsuccessful, you must call us to schedule work.

EXCLUSIONS:

There shall be no liability under this agreement.

1. Heat exchanger, coil, compressor, electronic air cleaners and humidifiers are not covered by the agreement.
2. For structured alterations to the premises within which the equipment included is installed, necessary for service or parts repair or replacement as provided for in this agreement.
3. For any default, delay in performance or extraordinary damage hereunder caused by any contingency beyond our control including war, government restrictions or restrains, strikes, fire, floods, vandalism, wind police actions, riots, acts of God, short or reduced supply of any material or tarnished product. In such cases, the customer shall be charged for the parts and labor involved at the then current price for such items. No such parts or labor shall be furnished, however, without authorization of customer.
4. For any consequential damages of any nature whatsoever, including damages arising because of or resulting from failure of a component part of the included equipment, or the inspection, maintenance or repair of said equipment.
5. which in any way duplicates protection provided under any other existing warranty or agreement.
6. Fore system design or performance in maintaining design conditions except through failures of equipment specifically covered herein.
7. For failure to discover conditions necessitating repairs or replacement.
8. Not responsible for any pre-existing conditions.
9. Cabinets and duct work.
10. Water supply and drain beyond the equipment proper.
11. Electrical service beyond the equipment (control wiring excepted).
12. Moving or relocating the equipment.
13. Any damage due to unexpected freezing. Work made necessary by the enforcement of government codes, building and union regulations.
14. Devices and controls not supplied by us are excluded from these agreement unless otherwise specified in the agreement. We are not responsible for failure or damage to equipment or premises due to improper fuel or fuel supply.
15. Digital thermostat not supplied by us are not covered by this agreement, if a thermostat needs to replaced in these cases a standard thermostat will be used.
16. Any part no longer available.
17. Any and all special and consequential property damages due to or related to equipment or failure of same.
18. Refrigerant leaks: This agreement does not pay for refrigerant, refrigeration lines or coil repairs.

CONDITIONS:

The only parties to this agreement are customer and dealer signing it and A Advantage.
The time, means and methods to be employed by our company in the performance of this agreement are solely with in our company’s discretion.
Repair or replacement of defective materials, parts or units is solely within our company’s discretion.
This agreement shall be void if the covered equipment, in our company’s judgment, has been subject to misuse, negligence, accident, fire, lighting, windstorm, or vandalism, or if the equipment has been tampered with or altered in any way or operated contrary to the manufacturer’s instructions.

TERMINATION:

This agreement may be terminated upon nonpayment of any amount when due. It may also be terminated by either party with a 30 day written notice. Unearned premiums may be refunded but not to include the month of termination. If this agreement becomes terminated, our company shall immediately cease coverage and we shall have no further obligation of any nature whatsoever.
